Man Sues Microsoft For $600 Million For Windows 10 Upgrade

Half a billion in damages for a botched Windows 10 upgrade? I’ve heard worse! It looks like forced upgrades to the latest version of its operating system are still causing problems for Microsoft.

The company has been in the news occasionally for these aggressive Windows 10 upgrades that had users taking it to court over the issue. This latest one is rather interesting, because a man from Albuquerque, New Mexico is asking for the sky.

A former Windows 7 user, Frank Dickman says that his computer was upgraded automatically to the latest OS, which made it completely useless.

According to the report, he just wants to downgrade from Windows 10 to Windows 7 with a digital download and an activate code offered by Microsoft. Unless the software giant complies in 30 days, the dispute moves to court.

The lawsuit (PDF file) reveals that the ASUS 54L notebook that Dickman was using became non-functional after the upgrade to Windows 10.

And he now says that Microsoft should pay $600 million in damages:

“The only sensible remedy is for Microsoft Corporation to supply the OEM version of its operating system by download from its website and confirmed by the key code which came with the computer.

Failure of Microsoft Corporation and its CEO (Satya Nadella) to provide this function within thirty days of the provided summons should yield a payment from the two defendants to the plaintiff of a remedy… of six hundred million dollars.”

Interesting that he names Microsoft CEO Satya Nadella directly in this, but there you have it.

In any case, Redmond is expected to seek a settlement one way or another, as it has done several times in the past. One high profile case was started in 2016 by a woman in California, where Microsoft agreed to pay $10,000 after her computer was upgraded to Windows 10 without her consent.
